Duty to Defend
Unlike some D&O policies that only reimburse insureds for legal expenses, SCPIE will arrange for attorneys to represent you and will supervise your defense in the event of a covered claim. In addition, SCPIE will help you right away, even before your policy retention (similar to a deductible) is exhausted.

Entity Coverage
If a lawsuit names your medical corporation in addition to naming you personally, your D&O policy will cover the corporation as well.

Coverage for Subsidiaries
The policy provides automatic coverage for your corporation’s existing subsidiaries. It also provides automatic coverage for created or acquired new subsidiaries, provided that each new subsidiary’s assets represent less than 20% of your corporation’s total assets. (If such assets are greater than 20%, coverage can be purchased for an additional premium, subject to underwriting approval.)

Coverage for Outside Directors, Officers and Trustees
If you serve as a director, officer or trustee of an outside not-for-profit 501(c)(3) company at the specific written request of your medical corporation, you’ll be covered for legal exposure in your outside role.

Spousal Liability Coverage
If you are the focus of a lawsuit, and your spouse is also named because of his or her legal connection to your assets, your spouse will be covered.
